Terms of Service

By accessing or using GridBoss ("the Service"), operated by Richard P Scott & Associates LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

GridBoss is a cloud-based field service management platform that provides scheduling, dispatch, customer management, invoicing, estimates, SMS notifications, online payments, and reporting tools for service businesses.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.
• One organization account represents one business entity. You may not share accounts between unrelated businesses.

We offer a 14-day free trial on all plans. No credit card is required to start. At the end of the trial, you must select a paid plan to continue using the Service. If you do not subscribe, your account will be deactivated but your data will be retained for 90 days.

• Subscription fees are billed monthly based on your selected plan (Starter, Pro, or Business).
• Payments are processed securely by Stripe. You authorize us to charge your payment method on a recurring basis.
• Prices may change with 30 days' advance notice.
• SMS overages beyond your plan's included messages are billed at the stated overage rate.
• Refunds are not provided for partial months of service.

By using GridBoss to send SMS messages, you agree to the following:

• You will only send messages to customers who have provided their phone number and have given consent to receive transactional text messages from your business.
• When collecting a customer's phone number (by phone, in-person, or online), you will inform the customer that they will receive transactional text messages about appointments, job updates, and invoices, and obtain their verbal or written confirmation before saving their contact information in GridBoss.
• You will not use the SMS feature for marketing, promotional, or spam messages.
• You will honor opt-out requests (STOP) promptly.
• You are responsible for compliance with all applicable messaging laws, including the Telephone Consumer Protection Act (TCPA) and carrier guidelines.
• Message and data rates may apply to message recipients. Message frequency varies based on service activity.

End customers can reply STOP to opt out of messages at any time, or reply HELP for assistance.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Upload malicious code or content.
• Use the Service to send unsolicited messages (spam).
• Resell or sublicense the Service without our written permission.

You retain ownership of all data you enter into GridBoss, including customer records, job details, invoices, and notes. We do not claim ownership of your data.

You grant us a limited license to process, store, and transmit your data solely for the purpose of providing the Service. See our Privacy Policy for details on how we handle data.

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period.
• After cancellation, your data is retained for 90 days and then permanently deleted unless you request earlier deletion.
• We may terminate your account if you violate these terms, with or without notice.

We strive for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from downtime.

To the maximum extent permitted by law, GridBoss and Richard P Scott & Associates LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless GridBoss and Richard P Scott & Associates LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance of the new terms.

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
